Terms of Service

1. Who we are and what these Terms cover

aBetterGun (the “Game”) is run by Fun Based Games Ltd. (“Fun Based Games”, “we”, “us”), a company based in Israel. These Terms of Service (“Terms”) are an agreement between you and Fun Based Games. They cover your use of the Game at abettergun.com, including solo and co-op play, player accounts, progression, the Terran Vault, friends, contracts and the leaderboards.

By playing the Game or creating an account you agree to these Terms, to the Community Guidelines (which are part of these Terms), and to our Privacy Policy, which explains what data we collect and why. If you do not agree, please do not use the Game.

2. Who may play

• You must be at least 13 years old to create an account. By creating one, you confirm that you are.
• If you are under 18 (or the age of adulthood where you live), please read these Terms with a parent or guardian, and only play with their permission.
• You must not use the Game if we have banned you from it, or if using it is against the law where you live.

3. Your account

An account has a username and a password. An email address is optional. When you create an account you agree to these Terms and the Privacy Policy.

• Keep your password secret. You are responsible for what happens under your account. Tell us straight away if you think someone else is using it.
• An email address is optional, and it is your safety net. We have no other way to contact you about your account, for example about a moderation decision. We never use it for marketing.
• One person per account. Do not share, sell or transfer your account, and do not make extra accounts to get around a ban or a restriction.
• Your account is yours to manage. In Settings, Account, you can change your email address and password and delete your account. See the Privacy Policy for what deleting your account does to your data.

4. Usernames

Your username is shown to other players: in lobbies, in co-op runs, on friends lists and on the leaderboards.

• It must follow the Community Guidelines: no offensive, hateful or sexual names, no personal information or web addresses, and no pretending to be another player or someone from Fun Based Games.
• A name that breaks the rules may be renamed by an administrator.

5. Your licence to play

As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable licence, which we can withdraw, to use and play the Game in your web browser (including as an installed web app) for your own non-commercial fun. We keep all other rights.

6. Rules of play

The Game is built on a server that decides what happens, and it only works if everyone plays it as intended. You agree that you will not:

• Cheat. Do not use bots, scripts, macros, modified game clients, or any tool that plays for you or gives you information or abilities the Game does not provide.
• Exploit bugs. If you find a bug that gives an advantage, report it to us instead of using it. Deliberately abusing bugs, tampering with game state, network messages, rewards or leaderboard results is not allowed.
• Attack the service. Do not probe, scan, overload or interfere with our servers, get around access controls, or try to get into other players’ accounts or data.
• Harass anyone. Follow the Community Guidelines in your username and in anything you send us. No harassment, hate, threats, sexual content, spam, or sharing anyone’s personal information.
• Misuse the Game commercially. Do not sell access, accounts or in-game items, and do not scrape, copy or redistribute the Game or its content except where the law allows it.
• Break the law. Do not use the Game for anything illegal.

7. There is no free-text chat

The Game has no chat where you can type to other players. Other players see your username, your class and equipment, and what you do in a run. If you invite friends, they see an invitation from your username.

8. Reporting a player or content

You can report a player from the friends screen in the Game. For anything else, such as something you believe is illegal, email contact@funbasedgames.com. Please include the username involved, roughly when it happened, what happened, and your email address so we can reply. We read every report, and we do not tell a reported player who reported them. This address is also our contact point for authorities.

9. Your content

The only things you put into the Game are your username and anything you send us, such as a report or an email (“Your Content”). You keep any rights you have in it. You give Fun Based Games a worldwide, free licence to store, show and use Your Content as needed to run the Game: for example to show your username to other players and on the leaderboards. You are responsible for Your Content and confirm that it does not break anyone’s rights or these Terms.

10. Our content and intellectual property

The Game, including its name, logo, code, rules, maps, artwork, 3D models, sound and text, is owned by Fun Based Games Ltd. or licensed to us, and is protected by copyright, trademark and other laws. Some fonts and sounds are licensed from others; they are listed on the Credits page and stay under their own licences.

You may not copy, change, distribute, sell, reverse-engineer or make derivative works from the Game, except where the law clearly allows it or we have given written permission. Sharing screenshots, streams and videos of your own play is welcome. If you believe something in the Game infringes your copyright, email us at contact@funbasedgames.com with enough detail for us to find and assess it.

11. Free to play, game currency, and changes to the Game

The Game is currently free, with no advertising and no purchases for real money. Terran Credits and the other in-game currencies and items are earned by playing. They have no cash value, cannot be bought, sold or traded for money, and we may rebalance, reset or remove them as the Game changes. If we ever add paid features we will update these Terms and tell you clearly before you are charged anything.

The Game is under active development. We may add, change or remove features, rules, levels, weapons, items or modes at any time, and we may suspend or end the Game (in whole or in part) with or without notice. Online play depends on our servers and your internet connection, so runs may be interrupted, and we do not promise that progress will be kept.

12. Moderation: renames, suspensions and bans

If we reasonably believe you have broken these Terms or the Community Guidelines, or if the law requires it, we may warn you, rename your account, suspend it for a time, or permanently ban it. A suspended or banned account cannot sign in. Serious breaches, such as cheating, harassment or attacks on the service, can lead to an immediate permanent ban.

If we have an email address for the account, we will write to say what we did and why, and how to appeal. To appeal, reply to that email or write to contact@funbasedgames.com. A person will look at the decision again and tell you the outcome. Sections 9, 10 and 13 to 16 continue to apply after your account is closed.

13. Disclaimer of warranties

The Game is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Game will be uninterrupted, error-free, secure or free of bugs, or that any defect will be fixed. You use the Game at your own risk.

14. Limitation of liability

As far as the law allows, Fun Based Games and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, goodwill or profits, arising from or related to the Game or these Terms, however caused. Our total liability to you for all claims relating to the Game will not be more than the greater of what you paid us in the 12 months before the claim (currently nothing, as the Game is free) and US$50.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including for death or personal injury caused by negligence, for fraud, or your legal rights as a consumer.

15. Indemnity and governing law

You agree to compensate Fun Based Games for any losses, costs and reasonable legal fees arising from a claim by someone else that is caused by Your Content or by your breach of these Terms or the law, as far as the law where you live allows.

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules, and any dispute will be brought in the competent courts of Tel Aviv-Jaffa, Israel. If you are a consumer in a country whose laws give you the right to bring claims at home, or to rely on that country’s mandatory consumer protections, nothing in this section takes those rights away. If you have a problem with the Game, please contact us first. Most issues can be sorted out quickly by email.

16. Changes to these Terms, and contact

We may update these Terms from time to time. The “Last updated” date at the top shows the current version. For important changes we will give notice in the Game or on this page before they take effect; if you keep playing after that, you accept the updated Terms. If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a part of these Terms, that does not mean we have given it up.
